• Ticket Listings: Sellers list tickets for sale on our platform. SeatSpark does not guarantee the availability or accuracy of any ticket listing.
• Pricing: Ticket prices on SeatSpark are set by individual sellers and may be higher or lower than the original face value. All prices displayed on listings are subject to change until a purchase is confirmed.
• Fees: All purchases are subject to service fees, delivery fees, and any applicable taxes, which will be clearly displayed before you complete your purchase.

3. Buyer Guarantee

All purchases on SeatSpark are covered by our 100% Buyer Guarantee, as detailed in our Refund Policy. This guarantee ensures that you will receive authentic tickets, delivered on time, for the seats you ordered, or a full refund if an event is canceled and not rescheduled.

4. User Accounts

• Account Creation: To access certain features of the Service, you may be required to create an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.
• Account Security: You are responsible for safeguarding your password and for any activities or actions under your account. You agree to notify SeatSpark immediately of any unauthorized use of your account.

5. Prohibited Conduct

To the fullest extent permitted by applicable law, SeatSpark shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (a) your access to or use of or inability to access or use the Service; (b) any conduct or content of any third party on the Service; or (c) unauthorized access, use, or alteration of your transmissions or content.

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law principles.
